Judge to Bush: You Must Obey the Law
Posted by MEC on October 19, 2007
U.S. Magistrate Judge John M. Facciola has told George W. Bush in no uncertain terms that the Presidential Records act applies to him.
Facciola said it is necessary to hold out the threat of a contempt-of-court citation to ensure that White House personnel safeguard backup tapes of electronic messages that may have been deleted.
[...]
The Federal Records Act and the President Records Act require that all e-mails be saved.
Don’t expect the Busheviks to respect Judge Facciola’s authority in the matter of interpreting law:
In a hearing before Facciola on Wednesday, the Justice Department argued strenuously against the course of action the magistrate ended up taking.
I can only wonder how many incriminating e-mails have already been wiped out; they’ve had plenty of time to work on it while they argue against the rule of law. What we really need is a special prosecutor to be assigned to the case, and a judge to rule that the prosecutor can impound the White House and RNC servers.

Didn’t they learn their lesson from the Nixon tapes? I guess not…

They did. The lesson they learned was, “Stonewall long enough to have time to destroy the evidence.”

But how do they destroy the evidence of having destroyed evidence? Like the missing 18 1/2 minutes in the Nixon tapes, there is no credible basis for the missing e-mails and other records, so they seem to be trying to play to prevent their fictitious privilege claims from being overruled.
