Nancy Pelosi and Steny Hoyer, the Republicans, and the Blue Dogs betrayed their oaths of office today by voting to immunize telecommunications companies for their past unlawful wiretapping of Americans. This represents an overreaching of congressional powers into the judicial realm, an obstruction of justice, and a slap in the face to the citizens who brought the lawsuit in the first place. The Electronic Frontier Foundation says:

Privacy rights and the rule of law took a serious blow today when the House of Representatives passed blanket retroactive immunity for phone companies that participated in the president’s warrantless surveillance program. The FISA Amendments Act, H.R. 6304, which House Leadership rushed to the floor today after its introduction yesterday, passed by a vote of 293 to 129. The Senate is expected to vote on the bill next week.

The one Republican who voted Nay is Johnson of Illinois. 105 Democrats joined the treachery:

Here are Steny Hoyer’s opponents: Republican Collins Bailey and Libertarian Darlene H. Nicholas. Bailey is a Christian Rightist with extreme economic beliefs. Darlene Nicholas is a Business Libertarian, who left the Republican Party when she read Ayn Rand. If the thought of supporting either of those makes you ill, you can donate to the Blue America PAC.

    I don’t see how it can be, Kathy. One would have to argue it on Constitutional grounds, that somehow this does not fall in the purview of Congress. I think that under the Commerce clause it technically does, even though it amounts to a bill of attainder and an interference in the judiciary.
